Terms & Conditions
CONTRACT
All bookings are made with Motivational Movement LLC (MM). By signing the application you acknowledge that you have read, understand and agree to be bound by these Terms. If you sign on behalf of other participants, you guarantee that you have the authority to accept and do accept these Terms on behalf of the other participants in your party. Your application is confirmed and a contract exists between us when MM receives registration and initial payment.

DEPOSIT
You are required to pay a deposit of $592.50 USD (or $767 for Budget Friendly option) per person for registration to be confirmed. This deposit is fully refundable for 60 days after which point it is non-refundable. If you register within 60 days of January 1st of the contract year (the new year) then the deposit is non-refundable.

FINAL PAYMENTS
Payment of the balance of the registration price is due 60 days before selected runcation. If this balance is not paid on or before the due date we reserve the right to treat your registration as cancelled.

PERSONAL DETAILS
In order for us to confirm your registration you must provide all requested details with your initial payment. Necessary details include but are not limited to your full name as per passport/ license, date of birth, running history, time of your fastest 5k within the past 12 months, dietary requirements and any pre-existing medical conditions you have which may affect your ability to participate in an MM activity. Participants who were registered by someone else are responsible for providing this information to MM. Failure to provide requested details may result in additional charges or non-refundable cancellation of your registration.

MEDICAL INFORMATION
You must disclose any pre-existing medical conditions which may impact your ability to perform fitness activities, to travel, participate in a running trip, visit remote areas or which may adversely affect the experience of others in the group. MM reserves the right to deny you permission to travel or participate in any aspect of a runcation at any time and at your own risk and expense where MM determines that your physical or mental condition renders you unfit for activity and/or travel or you represent a danger to yourself or others. MM does not provide medical advice. You should consult your physician to confirm your fitness capabilities, participation in any planned activities and for advice on vaccinations and medical precautions. It is your responsibility to assess the risks and requirements of each aspect that you may participate in with MM based on your own circumstances, limitations, fitness level and medical requirements.
CANCELLATION BY YOU
Cancellation is considered initiated on the date that MM receives written confirmation from you.
If you cancel:
61+ days from the new year date (but after the 60 day grace period): 50% of total payment refunded
60 days or less from the new year: No refunds on deposit, 50% refunded if total balance was paid
60 days or more from the selected runcation date: 50% if total balance was paid
60 days or less from the selected runcation date: No refunds*
*If you do not pay the balance by the due date and cancel after the fact, MM will retain all payments that have been made.
CANCELLATION BY US
MM may cancel a runcation at any time up to 10 days before the new year if the runcation has not met the minimum attendee numbers. MM may cancel a trip at any time prior to departure due to terrorism, natural disasters or other external events that prevent us from safely operating the planned itinerary. If MM cancels your trip because attendee numbers are low refunds will be given, or you can choose an alternate runcation in that year. In circumstances where the cancellation is due to external events outside MM's reasonable control refunds will not be given, and you may choose an alternate runcation in that year. MM is not responsible for any incidental expenses that you may have incurred outside of what is stated in the "INCLUSIONS" or "EXTRA INCLUSIONS" area of these terms.

TRANSFERS
You can transfer registration to another individual with MM's written approval.
All choices for runcations are final. There will be no transfers of runcations unless MM makes the call for cancellation of a runcation.

All accommodation as listed on the Details page for your runcation (Always a top rated Airbnb)
All transport as listed on the Details page for your runcation
All groceries as listed on the Details page for your runcation (groceries chose mainly by the runners)
All runs as listed on the Details page for your runcation
All extra activities and sightseeing as listed on the Details page for your runcation
Pre-runcation communication and guidance
A swag bag with gifts MM desires to include at that time (at least $150 worth)
Experienced trip leader

EXCLUSIONS
The price of your registration does not include:
Flights
Visa and passport fees
Travel insurance
Optional activities or personal expenses
Anything that is not as inclusions or extra inclusions listed on the Details page for your runcation

AGE REQUIREMENTS
Minimum Age: Our training and runcations are intended for adults over the age of 21, though exceptions may be made for certain prospective members under the age of 21, but at least 18 years of age, who are capable runners and comfortable in an adult environment. MM reserves the right to approve or deny a spot to a prospective member.

Maximum Age: We have no maximum age limit though our training and runcations are physically active and participants must ensure that you are capable of participating fully and safely. It is your responsibility to obtain proper and detailed medical advice prior to participation.

PHYSICAL REQUIREMENTS
Prospective applicants must be able to run a 5k in 28 minutes or faster. Proof of run time must be made available at the time of applying. Training and activities can be physically demanding and participants must ensure that you are capable of participating fully and safely.

APPLICANTS AND GROUP SIZES
A maximum of 48 applicants, in addition to trainer, will be allowed each year. Each runcation has a specific set of minimum and maximum number of participants. If a runcation has not met the minimum group size 60 days before the runcation date then MM reserves the right to cancel that runcation. Though cancellation is a last resort, participants should be aware of the possibility and refrain from booking flights until given confirmation that the runcation is going to happen. In the event that MM cancels a runcation, transfer to another runcation of that same year will be allowed.

PASSPORT AND VISAS
If from out of the United States you must carry a valid passport and obtain all of the appropriate visas, permits and certificates for the countries which you will visit during your trip. Your passport must be valid for 6 months beyond the duration of the trip, or for the length of time specified by your country. We are not responsible if you are refused entry to a country because you lack the correct passport, visa or other travel documentation.

TRAVEL INSURANCE
Travel insurance or a signed waiver declining coverage is mandatory for all applicants wanting to partake in the runcations. If you choose travel insurance it should cover against personal accident, death, medical expenses and emergency repatriation. We also recommend that it covers cancellation, lost luggage and personal effects. You must provide proof of travel insurance or a signed waiver declining coverage prior to the runcation start date or you will not be permitted to participate in the runcation.

CHANGES TO ITINERARY
MM reserves the right to make itinerary adjustments when necessary if we deem a scheduled run, activity or destination unsafe due to weather conditions or other local considerations.

AUTHORITY ON TOUR
Our runcations are run by at least one experienced group leader serving as the Head Guide. The decision of the Head Guide is final on all matters related the safety or well-being of all trip participants. If you fail to comply with a decision made by the Head Guide or interfere with the well-being of the group, the Head Guide may direct you to leave the runcation immediately, with no right of refund. You must at all times comply with the laws, customs, foreign exchange and drug regulations of all countries visited.

ACCEPTANCE OF RISK
You acknowledge that the nature of the training and runcation is active and participation involves a degree of personal risk and physical fitness capabilities. You may be visiting places where the politics, culture and geography present dangers and physical challenges greater than those present in your daily life. It is your own responsibility to acquaint yourself with all relevant travel information and the nature of your itinerary.

EXTRA ACTIVITIES AND SIGHTSEEING
You accept that any assistance given by your guides in arranging extra activities or sightseeing does not render MM or MM guide liable for them in any way.

PHOTOS AND MARKETING
You give your permission and royalty-free license to us using images of you taken during the runcation for advertising and promotional purposes, both in print and digital mediums.

PRIVACY POLICY
Any personal information that we collect about you may be used for any purpose associated with the operation of a runcation or to send you marketing material in relation to our runcation, events or news. Your details otherwise will not be disclosed nor sold to any third-party.

DISCLAIMER/STATEMENT OF RESPONSIBILITY
We contract with a network of companies and individuals to assist in the running of our runcations and training videos. Because MM does not maintain any control over the personnel, equipment, or operations of these suppliers, we assume no responsibility for and cannot be held liable for any personal injury, death, property damage, or other loss, accident, delay, inconvenience, or irregularity which may be occasioned by reason of (1) any wrongful, negligent, willful, or unauthorized acts or omissions on the part of any of the suppliers, or other employees or agents, (2) any defect in or failure of any vehicle, equipment, instrument owned, operated or otherwise by any of these suppliers, or (3) any wrongful, willful, or negligent act or omissions on any part of any other party not under the supervision or control of the Operator.
